■制定の目的

「くらげさんとしつ爺」はこれから、ファン創作を中心としたファンのみなさまとの双方向のコミュニケーションを通して、盛り上がり続けるコンテンツになることを目指したいと思っております。
ファン創作は、「くらげさんとしつ爺」を愛していただいている表現方法の一つであると理解をしており、それらのファン創作活動を敬意をもって応援していきたいと考えております。
そのために[くらげさんとしつ爺]のファン創作活動ガイドラインを設定させていただきました。これは、これまで・これからのみなさまの活動を何ら制限する意図はなく、可能な範囲で少しずつ公認化していくことを目的に設定しております。
どのようなルールを定めても、ルールには必ず何らかの抜け穴が生まれますので、ガイドラインという形をとっています。もしご自身の活動がガイドラインの範囲内か迷ったときは「その活動で、公式や、他のファンのみなさんが困らないか」という観点で考えていただけましたら幸いです。
このガイドラインの設定によって、みなさまが楽しくファン創作活動ができ、またその作品に対して素直にいいね！と言いあえる、みんななかよく「くらげさんとしつ爺」を楽しめる、そんなコンテンツになればという願いをこめています。

■ガイドラインの対象範囲

1. 本IPのうち、第三者の権利物を除く範囲は、すべて対象範囲とします。

・第三者の権利物
　・（例）小説のオリジナルシナリオ部分
　・（例）アニメのオリジナルキャラクターの二次創作

2. 基本的には「非営利目的」のファン創作のみを対象とします。
　a. 営利用途の場合は、別途お問い合わせください。
　b. 以下をすべて満たす場合は「非営利目的」のファン創作とします。
　　（1）制作と利用の主体がいずれも企業でないこと
　　（2）趣味の範囲で制作したファン創作であること
　　（3）他のコンテンツや商品などを宣伝する目的ではないこと

■総則

1. 喧嘩をせず、楽しんで創作ください
2. IPオーナーや周りのファンへの敬意を最大限払ってください
3. ガイドラインの解釈に迷った際は、「IPオーナーや周りのファンに迷惑が掛からないか」という観点に立ち返って、考えてください

■禁止表現

コミュニティを健全に保つため、以下のファン創作は禁止します。

1. 当IP、その関係者、ファン、その他あらゆる方の気持ちや名誉、考え方、ブランドイメージなどを傷つける目的のもの
2. 特定の政治・宗教を過度に推す、または貶すもの
3. 周りの方々への配慮の伴わない過度な暴力的・グロテスク表現を含むもの
4. 他人の権利を侵害しているもの
5. 事実に反して、公式作品、または当社から利用の許諾・協賛・提携を受けていると誤認される可能性のある様態のもの（たとえば公式ロゴの利用など）
6. 誤情報や、事実の一部に対する誇張などによって、誤認を誘う情報を伴うもの
7. 個人情報を含むもの
8. その他反社会的な表現のもの

9．R-15(18) 以上の表現全般
・未成年のキャラクターに飲酒・喫煙・運転等をさせる表現
・当IPの世界感や本来のキャラクター性を大きく逸脱する、またはイメージを損なうもの

10．AIによるイラストの生成・加工・学習の一切

■ファン創作の権利

ファン創作を公開する際、別途の利用範囲の宣言をしない限り、本ガイドラインと同様のライセンスで作品を公開したことになります。

■IPオーナーの裁量と権利

1. IPオーナーの裁量には必ず従ってください。
　IPオーナーも人間ですので、難しい判断に迫られることもあります。
　そこは、みなさんで温かく見守ってください。
2. 例えガイドラインに沿ったファン創作活動であっても、IPオーナーはその利用を取り下げる権利があります。

■販売・収益化を伴う利用方法

以下の例のように、販売・収益化を許可する場合の利用方法を記載ください。

1. 「ガイドラインの対象範囲」の２．に記載する「非営利目的」で、かつ以下の利用用途であれば、自由にファン創作が可能です。
　（1）即売会会場での販売全般
　（2）即売会会場以外において、以下の販売
　　（2-1）書籍（デジタルを含む）
　　（2-2）音楽（デジタルを含む）
　　（2-3）映像作品（デジタルを含む）
　　（2-4）立体物を除く、5000円以下のグッズ
　　（2-5）立体物（ぬいぐるみ・フィギュア）
2. 「ガイドラインの対象範囲」の２．に記載する「非営利目的」に当てはまらない場合であっても、以下の利用用途であれば、自由にファン創作をいただくことが可能です。
　（1）pixivFANBOXやPatreon内での公開
　（2）YouTube、ニコニコ動画、Twitchの各種収益化機能の利用
　※ 目の届かない場所での思わぬ方法の収益化を防ぐため、サービス名の明記をお勧めします。

■その他

1. IPオーナーは、皆さまに発生したいかなる権利侵害、損害および第三者との紛争について一切責任を負わず、また賠償などを行いません。
2. IPオーナーは、以下のようなことを守るため、本ガイドラインに関する個別のお問い合わせにはお答えできないことがあります。疑問や難しい解釈については、原則として「総則」に沿った判断をお願いします。
　a. 公平性の担保
　b. 喧嘩の防止
　c. ガイドラインの複雑化を防ぐため
　d. その他、現段階で判断を求められてしまうと「NG」と答えざるを得ないが、本来は見守りたい範囲の活動であって、そこを禁止してしまうことを防ぐため
3. このガイドラインは、予告なく変更されることがあります。

■ Purpose of Guidelines

[Kuragesan and Mr.Situjii] intends to foster content that will continue to thrive through interactive communication with fans, especially fan creations.
We understand that fan creations are one of the ways fans express their love for Kuragesan and Mr.Situjii , and we intend to support such fan creation activities with respect and admiration.
For this reason, we have established the Kuragesan and Mr.Situjii Fan Creation Guidelines. These guidelines are not intended to restrict your past or future activities in any way, but rather to gradually formalize and approve them to the extent possible.
No matter what rules are established, there will always be some loopholes, which is why we have structured them in the form of guidelines. If you are unsure whether your activities fall within the guidelines, we would appreciate it if you could consider whether such activities would cause any inconvenience to official channels or other fans.
Through the establishment of these guidelines, our hope is that everyone can enjoy fan creation activities happily and freely express their appreciation for the works. We aim to create a community where everyone can enjoy [IP Title] together in harmony.

■ Scope of Guidelines

1. The scope covers everything within the IP except for items that are under third-party rights.

- Third-Party Rights
- (Example) Original scenario parts of media franchised novels.
- (Example) Fan creations of anime-only characters.

2. Fundamentally, only “non-commercial” fan creations will be in the scope.
　a. For commercial use, please inquire separately.
　b. Fan creations that meet all of the following criteria are deemed “non-commercial”:
　　(1) Neither the production nor the use is carried out by a business entity.
　　(2) It is a fan creation produced within the scope of a hobby.
　　(3) It is not for the purpose of promoting other content or products.
　　(4) Compensation equivalent to costs such as raw materials, production tools, etc.
　　(Items where costs and revenue are expected to be approximately equal, with no anticipated profit.)

■ General Provisions

1. Please enjoy creating without disputes.
2. Please show utmost consideration to the IP owner and other fans.
3. If you are unsure about interpreting the guidelines, please consider from the perspective of whether it will cause inconvenience to the IP owner and other fans.

■ Prohibited Expressions

To maintain a friendly community, the following fan creations are prohibited.

1. Content created with the intent to harm the feelings, honor, beliefs, or brand image of this IP, its affiliates, fans, or any other individuals.
2. Content that excessively promotes or disparages specific political or religious beliefs.
3. Content that includes excessively violent or grotesque expressions without consideration for others.
4. Content that infringes upon the rights of others.
5. Content that could be misidentified as an official work, or one that falsely implies endorsement, sponsorship, or partnership with official entities. (e.g. The unauthorized use of official logos, etc.)
6. Content that includes misleading information or exaggeration of facts leading to misinterpretation.
7. Content that includes personal information.
8. Content containing antisocial expressions or sentiments.

9.Expressions rated R-15 (18) and above.
- Depictions of underage characters consuming alcohol, smoking, driving, etc.
- Content that significantly deviates from the worldview and original character traits of this IP, or damages its image.
10. All AI-based illustration generation, processing, and learning

■ Rights of Fan Creations

When you publish fan creations, unless you make a separate declaration regarding the scope of usage, it will be considered that you have published the work under the same license as these guidelines.

■ Discretion and Rights of IP Owner

1. Please always adhere to the discretion of the IP owner.
The IP owner is human too, so they may face difficult decisions at times.
Let’s all warmly support them in those moments.
2. Even if fan creation activities comply with the guidelines, the IP owner reserves the right to withdraw permission for their use.

■ Usage Involving Sales and Monetization

Please provide the usage instructions for permitting sales and monetization as in the following example.

1. You may freely create fan works under “non-commercial” purposes as described in Section 2 of “Scope of Guidelines”, and for the following usage purposes.
　(1) Sales in artist alleys at conventions.
　(2) Sales outside of convention venues of the following items:
　　(2-1) Books (including digital formats).
　　(2-2) Music (including digital formats).
　　(2-3) Video works (including digital formats).
　　(2-4) Goods excluding three-dimensional objects, priced at 50 USD or less.
　　(2-5) Three-dimensional objects (plush toys, figurines).
Even if your creation does not fall under the “non-commercial” purposes described in section 2 of “Scope of Guidelines”, you are still free to create fan works for the following usage purposes.
　(1) Publishing on fan subscription platforms such as pixivFANBOX or Patreon.
　(2) Utilizing monetization features on YouTube, Nico Nico Douga, and Twitch.
　※ To prevent unexpected monetization methods, we recommend specifying the service names.

■ Additional Notes

1. The IP owner shall not be liable for any rights infringements, damages, or disputes with third parties arising from your activities, nor will the IP owner provide compensation or similar.
2. To ensure the following, the IP owner may not be able to respond to individual inquiries regarding these guidelines. For questions or difficult interpretations, please make a judgment in accordance with the “General Rules” section in principle.
　a. Ensure fairness.
　b. Prevent disputes.
　c. Prevent guideline complexity.
　d. Prevent the prohibition of activities, that we need to prohibit if asked, but actually want to observe.
3. These guidelines are subject to change without prior notice.
